Access Restrictions
Only County internal GIS users and the County Regional Data Sharing Program partners are allowed to access this dataset subject to the terms and condition of the Regional Data Sharing Program Agreement. GIS users and Program partners received the updated dataset on DVD or CD via USPS mail.
Use Restrictions
The use constraints are governed and fully described in the partner's Regional Data Sharing Program Agreement with the County. Key points regarding the restrictions on the use of the data are as follows: County is the owner of the GIS Basemap. The GIS Basemap has been validated as Protected Critical Infrastructure Information (PCII) by the Department of Homeland Security. Pursuant to Section 29.8(g) of Title 6 of the Code of Federal Regulations, Licensee shall treat PCII as exempt from disclosure under the Freedom of Information Act, the California Public Records Act, or any other Federal, State or local law requiring disclosure of records or information. Licensee shall direct all such requests to the Licensor. The GIS Basemap is COPYRIGHTED BY THE COUNTY OF SANTA CLARA. No parts of the GIS Basemap may be reproduced or transmitted in any form or by any means, electronic or mechanical, including photocopying and recording, or by any information storage or retrieval system, except as expressly permitted by the terms of the Regional Data Sharing Program Agreement or in writing by the Licensor. Licensor is grant a non-exclusive, non-transferable, non-assignable license to use the GIS Basemap in accordance with the terms and conditions set forth in Regional Data Sharing Program Agreement. All maps and printouts must clearly state the following notice of copyright: (1) "Reproduced with permission granted by County of Santa Clara, (July, 2007) County of Santa Clara (Licensor seal)". (2) "Copyright (current year), County of Santa Clara, all rights reserved," or for lack of space, just c (with small circle around it) 2007. Licensee may use the GIS Basemap in the following manner: (1) Use on a Licensee wide basis and on an unlimited number of Licensee sites, provided the central processing units on which the GIS Basemap is maintained support only equipment operated by the Licensee, or on central processing units under the direction and control of Licensee, and the GIS Basemap is used only for the conduct of the Licensee's own internal business purposes; (2) Modify the GIS Basemap or merge the GIS Basemap into other databases for the Licensee's own internal business purposes; (3) Create one backup copy of the Database for legitimate archival purposes only, provided that the copy shall include Licensor's copyright and other proprietary notices. The Database and any copy shall be stored and maintained at Licensee's site; or (4) If it is necessary for Licensee to grant access to the GIS Basemap to its Agents, contractors, or consultants for the Licensee's business purposes, Licensee shall first obtain from each such Agent, contractor or consultant a signed copy of the Third Party Data Use Agreement. Licensee may NOT use the GIS Basemap in the following manner: (1) Reproduce, copy, publicly display, create Derivatives, market, distribute, disclose, sublicense, assign, disassemble, decompile, reverse engineer, alter, maintain, enhance, revise, modify, resell, loan, rent, lease or sublease, donate or share, or otherwise transfer the GIS Basemap without the prior, express written consent of Licensor; (2) Permit access in a manner that allows unauthorized access, downloading or copying; (3) Use to generate products or services for commercial resale; or (4) Display, print, show, exhibit, make visible, or reveal to the public.

Horizontal Positional Accuracy Report
Where a percentage appears below, it means that the stated percentage of features is the minimum percentage of features that will meet the requirement. Horizontal accuracy of adjusted data achieves 2 feet for the area covered by 3 inch pixel resolution orthophotos (valley floor) and 5 feet for the area covered by 9 inch pixel resolution orthophotos: 98%. The horizontal accuracy of the remaining 2% adjusted data will achieve 4 feet for the area covered by 3 inch pixel resolution orthophotos (valley floor) and 10 feet for the area covered by 9 inch pixel resolution orthophotos. For the areas where planimetric data exist, the accuracy of centerlines is measured relative to the center of the edge-of-pavements. For the areas where planimetric data do not exist, Assessor Maps and external agency street data will be used. The accuracy of centerlines is measured relative to the middle of the ROW on the two sides of the street. All street centerlines will be represented with true arcs.
